1 Eligibility & Account Registration
You agree to provide accurate information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account, including the acts of anyone you invite or permit to use it.
2 User Content & Acceptable Use
Ownership. You retain all rights in your User Content.
Your responsibility. You may upload content only if you have all necessary rights (copyright, model releases, trade-mark permissions, etc.). You are solely responsible for User Content and for any consequences of sharing it.
Prohibited content. You must not upload, publish, store or transmit content that:
- is illegal or promotes illegal activity, including instructions for wrongdoing;
- depicts or promotes firearms, explosives or other weapons;
- is pornographic or intended to be sexually gratifying;
- exploits or endangers children;
- is hateful, harassing or discriminatory;
- infringes intellectual-property or privacy rights;
- contains malware or similar harmful code.
Enforcement. Should we be made aware of a potential breach of these Terms or of applicable law, we reserve the right, at our sole discretion, to remove any User Content, suspend or terminate your account without refund, and report the matter to the relevant authorities.
3 Billing, Cancellation & Refunds
- Subscriptions are billed in advance. You may cancel your subscription from the dashboard at any time to prevent future renewal charges. Access will continue until the end of your current paid billing period.
- You may request a full refund within 14 days of your initial purchase. After the 14-day refund period has expired, subscription payments are non-refundable, and we do not provide refunds or credits for unused subscription time or partial billing periods, except where required by applicable law.
- We may suspend or terminate the Service or your account immediately for material breach, suspected fraud, non-payment, or to comply with legal requirements.
- If we terminate your account because of your breach, any fees already paid are non-refundable, except where required by applicable law.
4 Disclaimers & Limitation of Liability
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, ImageZen disclaims all warranties, including fitness for a particular purpose and non-infringement.
5 Indemnification
You agree to indemnify and hold harmless ImageZen and its directors, employees and agents from any claims, damages, losses or expenses arising out of your User Content or breach of these Terms.
